Conditions générales d’utilisation

1. Objet

Les présentes conditions régissent l’accès et l’utilisation de la plateforme Boutiko (boutiko.store) par tout utilisateur, en particulier les marchands qui y ouvrent une boutique en ligne.

2. Définitions

« Boutiko » ou « la Plateforme » : le service en ligne édité par l’éditeur. « Marchand » : toute personne physique ou morale qui crée et exploite une boutique via Boutiko. « Client final » : toute personne qui achète auprès d’un Marchand. « Compte » : l’espace personnel du Marchand.

3. Acceptation

L’inscription et l’utilisation de la Plateforme impliquent l’acceptation pleine et entière des présentes conditions.

4. Description du service

Boutiko fournit un service logiciel (SaaS) permettant de créer et gérer une boutique en ligne, ses produits, commandes et paiements. Boutiko agit en qualité de prestataire technique : elle n’est ni vendeur ni propriétaire des produits proposés par les Marchands, lesquels vendent en leur nom propre.

5. Compte et inscription

Le Marchand fournit des informations exactes et à jour, et garde confidentiels ses identifiants. Il est responsable de toute activité réalisée via son compte.

6. Obligations du Marchand

Le Marchand s’engage à respecter la législation algérienne, notamment la loi n° 18-05 relative au commerce électronique (inscription au registre du commerce, interdiction des produits prohibés). Il est seul responsable des données personnelles de ses Clients finaux au regard de la loi n° 18-07, ainsi que de la licéité de ses contenus, prix et offres.

7. Obligations de Boutiko

Boutiko fournit le service avec diligence et met en œuvre des efforts raisonnables pour assurer sa disponibilité et sa sécurité. Le service est fourni « en l’état » ; aucune disponibilité ininterrompue n’est garantie. Le support est fourni selon le plan souscrit.

8. Propriété intellectuelle

La Plateforme, sa marque, ses logos et ses composants demeurent la propriété exclusive de l’éditeur. Le Marchand conserve la propriété de ses propres contenus et concède à Boutiko une licence limitée pour les héberger et les afficher.

9. Responsabilité

Boutiko ne saurait être tenue responsable des transactions, litiges, livraisons ou contenus relevant de la relation entre un Marchand et ses Clients finaux. Dans la limite autorisée par la loi, la responsabilité de Boutiko est plafonnée aux montants payés par le Marchand au cours des douze derniers mois.

10. Suspension et résiliation

Boutiko peut suspendre ou résilier un compte en cas de manquement aux présentes conditions ou à la loi. Le Marchand peut résilier à tout moment depuis son compte.

11. Modification des conditions

Boutiko peut modifier les présentes conditions ; les Marchands en sont informés et l’usage continu de la Plateforme vaut acceptation.

12. Droit applicable

Les présentes conditions sont régies par le droit algérien. À défaut de règlement amiable, tout litige relève de la compétence des tribunaux compétents algériens.

Terms of Use

1. Purpose

These terms govern access to and use of the Boutiko platform (boutiko.store) by any user, in particular merchants who open an online store on it.

2. Definitions

“Boutiko” or “the Platform”: the online service operated by the publisher. “Merchant”: any individual or company who creates and runs a store via Boutiko. “End customer”: any person who buys from a Merchant. “Account”: the Merchant’s personal space.

3. Acceptance

Registering and using the Platform implies full acceptance of these terms.

4. Description of the service

Boutiko provides software (SaaS) to create and manage an online store, its products, orders and payments. Boutiko acts as a technical provider: it is neither the seller nor the owner of the products offered by Merchants, who sell in their own name.

5. Account and registration

The Merchant provides accurate, up-to-date information and keeps their credentials confidential. They are responsible for all activity carried out through their account.

6. Merchant obligations

The Merchant undertakes to comply with Algerian law, in particular Law No. 18-05 on electronic commerce (trade-register registration, ban on prohibited products). The Merchant is solely responsible for the personal data of their End customers under Law No. 18-07, as well as for the lawfulness of their content, prices and offers.

7. Boutiko obligations

Boutiko provides the service diligently and makes reasonable efforts to ensure its availability and security. The service is provided “as is”; uninterrupted availability is not guaranteed. Support is provided according to the subscribed plan.

8. Intellectual property

The Platform, its brand, logos and components remain the exclusive property of the publisher. The Merchant retains ownership of their own content and grants Boutiko a limited licence to host and display it.

9. Liability

Boutiko cannot be held liable for transactions, disputes, deliveries or content arising from the relationship between a Merchant and their End customers. To the extent permitted by law, Boutiko’s liability is capped at the amounts paid by the Merchant over the last twelve months.

10. Suspension and termination

Boutiko may suspend or terminate an account in the event of a breach of these terms or of the law. The Merchant may terminate at any time from their account.

11. Changes to the terms

Boutiko may amend these terms; Merchants are informed and continued use of the Platform constitutes acceptance.

12. Governing law

These terms are governed by Algerian law. Failing an amicable settlement, any dispute falls under the jurisdiction of the competent Algerian courts.

شروط الاستخدام

1. الموضوع

تحكم هذه الشروط الوصول إلى منصة بوتيكو (boutiko.store) واستخدامها من قِبَل أي مستخدم، ولا سيما التجّار الذين يفتحون متجراً إلكترونياً عليها.

2. التعريفات

«بوتيكو» أو «المنصة»: الخدمة الإلكترونية التي يُديرها الناشر. «التاجر»: كل شخص طبيعي أو معنوي يُنشئ متجراً ويُديره عبر بوتيكو. «الزبون النهائي»: كل شخص يشتري من تاجر. «الحساب»: المساحة الخاصة بالتاجر.

3. القبول

يُعدّ التسجيل في المنصة واستخدامها قبولاً كاملاً لهذه الشروط.

4. وصف الخدمة

تقدّم بوتيكو خدمة برمجية (SaaS) تتيح إنشاء متجر إلكتروني وإدارته، بمنتجاته وطلباته ومدفوعاته. تعمل بوتيكو بصفة مزوّد تقني: فهي ليست بائعاً ولا مالكاً للمنتجات التي يعرضها التجّار، إذ يبيع هؤلاء باسمهم الخاص.

5. الحساب والتسجيل

يقدّم التاجر معلومات صحيحة ومحدَّثة، ويحافظ على سرية معرّفاته. وهو مسؤول عن كل نشاط يتم عبر حسابه.

6. التزامات التاجر

يلتزم التاجر باحترام التشريع الجزائري، ولا سيما القانون رقم 18-05 المتعلق بالتجارة الإلكترونية (التسجيل في السجل التجاري، ومنع المنتجات المحظورة). والتاجر وحده مسؤول عن المعطيات الشخصية لزبائنه النهائيين بموجب القانون رقم 18-07، وكذلك عن مشروعية محتوياته وأسعاره وعروضه.

7. التزامات بوتيكو

تقدّم بوتيكو الخدمة بعناية وتبذل جهوداً معقولة لضمان توفّرها وأمنها. تُقدَّم الخدمة «كما هي»؛ ولا يُضمَن توفّر متواصل دون انقطاع. ويُقدَّم الدعم وفقاً للعرض المُشترَك فيه.

8. الملكية الفكرية

تبقى المنصة وعلامتها وشعاراتها ومكوّناتها ملكاً حصرياً للناشر. ويحتفظ التاجر بملكية محتوياته الخاصة، ويمنح بوتيكو ترخيصاً محدوداً لاستضافتها وعرضها.

9. المسؤولية

لا تتحمّل بوتيكو المسؤولية عن المعاملات أو النزاعات أو عمليات التسليم أو المحتويات الناشئة عن العلاقة بين التاجر وزبائنه النهائيين. وفي الحدود التي يسمح بها القانون، تكون مسؤولية بوتيكو محصورة في المبالغ التي دفعها التاجر خلال الأشهر الاثني عشر الأخيرة.

10. التعليق والإنهاء

يجوز لبوتيكو تعليق حساب أو إنهاؤه في حال الإخلال بهذه الشروط أو بالقانون. ويمكن للتاجر الإنهاء في أي وقت من حسابه.

11. تعديل الشروط

يجوز لبوتيكو تعديل هذه الشروط؛ ويُعلَم التجّار بذلك، ويُعدّ الاستمرار في استخدام المنصة قبولاً.

12. القانون المطبَّق

تخضع هذه الشروط للقانون الجزائري. وعند تعذّر التسوية الودّية، يكون الاختصاص للجهات القضائية الجزائرية المختصة.

Conditions générales de vente (abonnements)

1. Objet

Les présentes conditions régissent la souscription par le Marchand aux offres d’abonnement payantes de Boutiko.

2. Offres et prix

Boutiko propose plusieurs formules (Gratuit, Starter, Pro, Business). Les prix sont indiqués en dinars algériens (DA) sur la page Tarifs et s’entendent toutes taxes applicables selon la réglementation en vigueur.

3. Paiement

L’abonnement est payable d’avance, par les moyens proposés (carte CIB/Eddahabia et autres moyens indiqués). La facturation est mensuelle ou annuelle selon le choix du Marchand.

4. Durée et renouvellement

L’abonnement est conclu pour la période choisie et se renouvelle automatiquement pour une période identique, sauf résiliation avant l’échéance.

5. Rétractation et remboursement

Le plan gratuit permet d’essayer le service sans engagement. Sauf disposition légale impérative contraire, les sommes versées au titre d’une période en cours ne sont pas remboursables au prorata.

6. Défaut de paiement

En cas de non-paiement, Boutiko peut suspendre l’accès aux fonctionnalités payantes après information du Marchand.

Terms of Sale (subscriptions)

1. Purpose

These terms govern the Merchant’s subscription to Boutiko’s paid plans.

2. Plans and prices

Boutiko offers several plans (Free, Starter, Pro, Business). Prices are shown in Algerian dinars (DA) on the Pricing page and include any applicable taxes under current regulations.

3. Payment

The subscription is payable in advance, via the offered methods (CIB/Eddahabia card and other indicated means). Billing is monthly or annual at the Merchant’s choice.

4. Term and renewal

The subscription is concluded for the chosen period and renews automatically for an identical period, unless cancelled before the due date.

5. Withdrawal and refund

The Free plan lets you try the service with no commitment. Unless a mandatory legal provision states otherwise, amounts paid for an ongoing period are not refundable on a pro-rata basis.

6. Non-payment

In the event of non-payment, Boutiko may suspend access to paid features after informing the Merchant.

شروط البيع (الاشتراكات)

1. الموضوع

تحكم هذه الشروط اشتراك التاجر في عروض بوتيكو المدفوعة.

2. العروض والأسعار

تقدّم بوتيكو عدّة عروض (مجاني، Starter، Pro، Business). تُعرض الأسعار بالدينار الجزائري (دج) في صفحة الأسعار، وتشمل كل الرسوم المطبَّقة وفق التنظيم المعمول به.

3. الدفع

يُدفع الاشتراك مُسبقاً عبر الوسائل المتاحة (بطاقة CIB/الذهبية وغيرها من الوسائل المذكورة). وتكون الفوترة شهرية أو سنوية حسب اختيار التاجر.

4. المدة والتجديد

يُبرَم الاشتراك للمدة المختارة ويتجدّد تلقائياً لمدة مماثلة، ما لم يتم الإلغاء قبل تاريخ الاستحقاق.

5. التراجع والاسترجاع

يتيح العرض المجاني تجربة الخدمة دون التزام. وما لم ينصّ حكم قانوني آمر على خلاف ذلك، فإنّ المبالغ المدفوعة عن مدة جارية غير قابلة للاسترجاع تناسبياً.

6. التخلّف عن الدفع

في حال عدم الدفع، يجوز لبوتيكو تعليق الوصول إلى الميزات المدفوعة بعد إعلام التاجر.

Politique de confidentialité (loi n° 18-07)

1. Rôles

Pour les données des Marchands (compte, facturation), Boutiko agit en tant que responsable de traitement. Pour les données des Clients finaux collectées via les boutiques, le Marchand est responsable de traitement et Boutiko agit en tant que sous-traitant, pour le compte du Marchand et selon ses instructions.

2. Données collectées

Selon le cas : identité et coordonnées, identifiants de connexion, informations de boutique et de commande, données de paiement (traitées par les prestataires agréés) et données techniques de navigation.

3. Finalités

Fournir et administrer le service, gérer la facturation, assurer le support, garantir la sécurité et améliorer la Plateforme.

4. Base légale

Le traitement repose sur l’exécution du contrat, le respect d’obligations légales et, le cas échéant, le consentement.

5. Hébergement et localisation

Conformément à la loi n° 18-07, les données personnelles sont hébergées en Algérie et ne font l’objet d’aucun transfert hors du territoire national sans base légale appropriée.

6. Sécurité

Des mesures techniques et organisationnelles appropriées sont mises en œuvre (contrôle des accès, chiffrement, sauvegardes) afin de protéger les données contre tout accès non autorisé, perte ou altération.

7. Durée de conservation

Les données sont conservées le temps nécessaire aux finalités poursuivies et aux obligations légales, puis supprimées ou anonymisées.

8. Droits des personnes

Toute personne dispose d’un droit d’accès, de rectification, de suppression et d’opposition. Pour les données de Clients finaux, ces demandes sont adressées au Marchand concerné ; Boutiko l’assiste en sa qualité de sous-traitant.

9. Autorité de contrôle

Les traitements sont déclarés, le cas échéant, auprès de l’Autorité nationale de protection des données à caractère personnel (ANPDP), auprès de laquelle toute réclamation peut être introduite.

10. Cookies

La Plateforme utilise des cookies nécessaires à son fonctionnement et, sous réserve de consentement, des cookies de mesure d’audience.

Privacy Policy (Law No. 18-07)

1. Roles

For Merchant data (account, billing), Boutiko acts as the data controller. For End-customer data collected through the stores, the Merchant is the data controller and Boutiko acts as the data processor, on the Merchant’s behalf and according to their instructions.

2. Data collected

Depending on the case: identity and contact details, login credentials, store and order information, payment data (handled by approved providers) and technical browsing data.

3. Purposes

To provide and administer the service, manage billing, deliver support, ensure security and improve the Platform.

4. Legal basis

Processing is based on performance of the contract, compliance with legal obligations and, where applicable, consent.

5. Hosting and location

In accordance with Law No. 18-07, personal data is hosted in Algeria and is not transferred outside the national territory without an appropriate legal basis.

6. Security

Appropriate technical and organisational measures are implemented (access control, encryption, backups) to protect data against unauthorised access, loss or alteration.

7. Retention

Data is kept for as long as necessary for the stated purposes and legal obligations, then deleted or anonymised.

8. Individual rights

Everyone has the right to access, rectify, delete and object. For End-customer data, such requests are addressed to the relevant Merchant; Boutiko assists as the data processor.

9. Supervisory authority

Where applicable, processing is declared to the National Authority for the Protection of Personal Data (ANPDP), with which any complaint may be filed.

10. Cookies

The Platform uses cookies necessary for its operation and, subject to consent, audience-measurement cookies.

سياسة الخصوصية (القانون رقم 18-07)

1. الأدوار

بالنسبة لمعطيات التجّار (الحساب، الفوترة)، تعمل بوتيكو بصفة المسؤول عن المعالجة. أمّا بالنسبة لمعطيات الزبائن النهائيين المجمَّعة عبر المتاجر، فالتاجر هو المسؤول عن المعالجة، وتعمل بوتيكو بصفة مناوِل (مُعالِج فرعي) لحساب التاجر ووفق تعليماته.

2. المعطيات المجمَّعة

بحسب الحالة: الهوية وبيانات الاتصال، معرّفات الدخول، معلومات المتجر والطلبات، بيانات الدفع (تُعالَج لدى المزوّدين المعتمدين)، والبيانات التقنية للتصفّح.

3. الأغراض

تقديم الخدمة وإدارتها، وإدارة الفوترة، وضمان الدعم والأمن، وتحسين المنصة.

4. الأساس القانوني

تستند المعالجة إلى تنفيذ العقد، والامتثال للالتزامات القانونية، وعند الاقتضاء إلى الموافقة.

5. الاستضافة والتوطين

وفقاً للقانون رقم 18-07، تُستضاف المعطيات الشخصية في الجزائر ولا تُنقَل خارج التراب الوطني دون أساس قانوني مناسب.

6. الأمن

تُتَّخذ تدابير تقنية وتنظيمية مناسبة (التحكّم في الوصول، التشفير، النسخ الاحتياطي) لحماية المعطيات من أي وصول غير مصرَّح به أو فقدان أو تغيير.

7. مدة الحفظ

تُحفَظ المعطيات للمدة اللازمة للأغراض المنشودة وللالتزامات القانونية، ثم تُحذَف أو يُزال طابعها الشخصي.

8. حقوق الأشخاص

لكل شخص الحق في الوصول والتصحيح والحذف والاعتراض. وبالنسبة لمعطيات الزبائن النهائيين، تُوجَّه هذه الطلبات إلى التاجر المعني؛ وتساعده بوتيكو بصفتها مناوِلاً.

9. سلطة الرقابة

تُصرَّح المعالجات، عند الاقتضاء، لدى السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي (ANPDP)، التي يمكن تقديم أي شكوى لديها.

10. ملفات تعريف الارتباط

تستخدم المنصة ملفات تعريف ارتباط ضرورية لعملها، وأخرى لقياس الجمهور رهناً بالموافقة.
